Surrogacy, also referred to as gestational surrogacy in the countries where various techniques are legal, is an agreement on bearing and delivering a child for another person.
The core of the method
The surrogate, or the gestational carrier, does not have any genetic relation to the child she is bearing. A preliminary stage implies the embryo being produced by the means of IVF from commissioning parents' gametes. According to a pending amendment, the use of one donor gamete is to be permitted in case one intended parent is infertile.

Important aspects
In a number of other countries, the embryo may be created through intrauterine insemination using the surrogate's egg (traditional surrogacy). However, such technique involves greater emotional load and can be more complicated legally, thus is now only rarely exercised.
In Russia, only gestational surrogacy may be performed. It is regulated by the Federal Law, which also prohibits surrogacy for non-medical purposes.
Under the Law, surrogates have parental rights, therefore a written consent is to be drawn up and signed to specify the rights of both parties. Once the names of the intended parents are included on the birth certificate, they legally become the child's parents, and the gestational carrier cannot claim for maternity rights.
Recommendations
In Russia, it is legal to commission a baby only if the intended parents are unable to have a child of their own. Such conditions include:
- Absence of the uterus,
- Deformity of the cervix or uterine cavity,
- Nonfunctional endometrium,
- Recurrent pregnancy loss (three or more spontaneous miscarriages),
- Recurrent failed IVF cycles with high-quality embryos (three or more).
